The said resolution was then agreed to.

Mr. Niblack moved that the vote last taken be reconsidered, and also moved that the motion to reconsider be laid on the table; which latter motion was agreed to.

The morning hour having expired,

The Speaker announced, as the business next in order, the motion submitted by Mr. Banks and pending when the House adjourned on Monday last, to suspend the rules so as to provide that Friday evening next be assigned to debate, without action, on the proposed acquisition of San Domingo.

And the question being put,

It was decided in the negative, two-thirds not voting in favor thereof. On motion of Mr. Spalding, the rules having been suspended for that purpose,

Resolved, That after Tuesday evening, the 16th instant, and until otherwise ordered, there shall be evening sessions, commencing at 73 o'clock, devoted exclusively to business from the Committee on Appro priations.

Mr. Benjamin F. Butler moved that the rules be suspended so as to provide that after Tuesday night the order for evening sessions for the consideration of the internal revenue bill be revoked; which motion was disagreed to, two-thirds not voting in favor thereof.

Mr. Brooks, as a question of privilege, moved that Florence Scannell be discharged from the custody of the Sergeant-at-arms.

Pending which, and the reading of a communication from said Scannell, sent to the Clerk's desk by Mr. Brooks, during his occupancy of the floor,

Objection was made to the further reading of the same, as out of order. The Speaker sustained the said point of order.

The question was then put, Shall the gentleman from New York be permitted to proceed in order?

And it was decided in the negative,

Mr. Boutwell moved the previous question; which was seconded and the main question ordered to be put.

The fifth amendment was then read as follows, viz: Strike out the first section and insert in lieu thereof:

"No discrimination shall be made in any State among citizens of the United States in the exercise of the elective franchise or in the right to hold office in any State on account of race, color, nativity, property, education, or creed.” And the question being put, Will the House agree thereto?
