On motion of Mr. Kelsey,

Ordered, That the Sergeant-at-arms be directed to arrest and bring to the bar of the House such of the members as are now absent without the leave of the House.

Mr. Holman moved that all futher proceedings in the call be dispensed with; which motion was disagreed to.

By unanimous consent, Mr. Holman was excused from further attendance to-day.

On motion of Mr. Bromwell,

Ordered, That the Clerk again call the roll, and that such members as fail to respond to their names be included in the warrant of the Speaker.

Mr. Covode and Mr. James M. Ashley failed to answer to their names. Mr. Covode was excused for non-attendance.

Mr. Schenck moved that the Sergeant-at-arms be directed to bring to the bar of the House at its meeting to-morrow such members as are now absent without leave.

The Speaker pro tempore decided, in view of the precedent in the last Congress, that the said motion was out of order in the absence of a quorum.

From this decision of the Chair, Mr. Schenck appealed.

Mr. Thomas L. Jones moved, at 10 o'clock and 25 minutes p. m., that the House adjourn; which motion was disagreed to.

Mr. Broomall submitted the following resolution, viz:

Resolved, That the Sergeant-at-arms be directed to bring the members now absent without leave before the bar of the House at one o'clock tomorrow, (Saturday, February 20, 1869,) or as soon thereafter as possible, and that they shall then be required to show cause why they should not be declared in contempt of the House, and abide the further order of the House.

Pending which,

Mr. Randall moved that the same be laid on the table; which motion was disagreed to.

The question then recurring on the said resolution,

Mr. Broomall moved the previous question, which was seconded and the main question ordered, and under the operation thereof the said resolution was agreed to.

Mr. Woodward moved that when the House adjourns, it adjourn until Monday next; which motion was disagreed to.

Mr. Paine proposed to submit the following resolution; which was decided out of order by the Speaker pro tempore, viz:

Resolved, That further proceedings under the call be suspended, and that the House now proceed to draw for seats, provided that gentlemen now present be permitted to retain their seats in case they should so desire.

The following memorials and petitions were laid upon the Clerk's table, under the rules, and referred as follows:

By Mr. Cadwalader C. Washburn: The petition of Isaac M. Adams, praying for a pension, to the Committee on Invalid Pensions.

By Mr. Gravely: The petition of R. W. Browning, of Prince William county, Virginia, praying for relief from political disability, to the Com mittee on Reconstruction.

By Mr. Thomas: A petition of similar import from J. W. Ware, of Clarke county, Virginia, to the Committee on Reconstruction.

By Mr. Buckley: Joint memorial of the Alabama legislature, relative to the payment of interest on certain funds improperly withheld from the State, to the Committee of Claims.

By Mr. Boutwell: The petition of Charles Watson, praying compen sation for services during the war as hospital assistant, to the same committee.

By Mr. Myers: The petition of citizens of the State of Pennsylvania, praying for such explanatory amendment to the patent laws as will cause American patents for inventions previously patented in foreign countries to expire here simultaneously with their expiration abroad, to the Committee on Patents.

By Mr. Fox: The memorial of the general assembly of New York, praying for pensions to the surviving soldiers of the war of 1812, to the Committee on Revolutionary Pensions.

By Mr. Selye: The petition of citizens of the State of New York, pray. ing for a change in the naturalization laws, to the Committee of Elections. Mr. Beck, from the Committee on Reconstruction, reported a bill (H. R. 1988) to relieve certain persons therein named from the legal and political disabilities imposed by the fourteenth amendment of the Constitution of the United States; which was read a first and second time, recommitted to the said committee, and ordered to be printed.

At the hour of 1 o'clock p. m., the Sergeant-at-arms, in pursuance of the order of the House of yesterday, appeared at the bar of the House having in custody the following-named members absent without leave on that day from the session of the House, viz:

Mr. Broomall submitted the following resolutions, viz:

Resolved, That all further proceedings under the call be dispensed with, and the Committee on Accounts be authorized to audit and allow to the Sergeant-at-arms a sum sufficient to reimburse to him his actual and necessary expenses incurred in procuring the attendance of members under the call, provided that the sum shall not exceed the legal fees and mileage.

Resolved, That all fines and costs imposed upon absentees during the call of the House be remitted.

Mr. Randall moved that the resolutions be laid on the table; which motion was disagreed to.

The question then recurred on the demand for the previous question; which was seconded and the main question ordered, and under the ope ration thereof the said resolutions were agreed to.

Mr. Broomall moved that the vote last taken be reconsidered, and also moved that the motion to reconsider be laid on the table; which latter motion was agreed to.

Mr. Holman, from the Committee on Enrolled Bills, reported that the committee had examined and found truly enrolled joint resolutions and bills of the following titles, viz:

H. Res. 120. Joint resolution in regard to the publication of postal conventions made with foreign countries.

H. Res. 458. Joint resolution granting the consent of Congress provided for in section 10 of the act incorporating the Northern Pacific Railroad Company, approved July 2, 1864.

H. R. 281. An act for the relief of Edwin B. Hoag; and

H. R. 1549. An act to restrict and regulate the franking privilege; When

The Speaker signed the same.

A message from the Senate, by Mr. McDonald, their chief clerk:

Mr. Speaker: The Senate have passed bills of the House of the following titles, viz:

H. R. 1906. An act to establish the collection district of Aroostook, in the State of Maine, and to more accurately define the boundaries of the district of Newark, New Jersey;

H. R. 1969. An act for the relief of Nott and Company;

H. R. 1345. An act to amend an act entitled "An act to confirm certain land claims in the Territory of New Mexico;"

without amendment; and

H. R. 1738. An act making appropriations for the current and contingent expenses of the Indian department, and for fulfilling treaty stipu lations with various Indian tribes, for the year ending June 30, 1870; with amendments, in which I am directed to ask the concurrence of the House.

The Senate have also passed a bill of the following title, viz:

S. 845. An act for the relief of Abbott Q. Ross,

in which I am directed to ask the concurrence of the House.
