Ordered, That he be excused from service on the Committee for the District of Columbia.

The Speaker appointed Mr. George W. Hughes, of Maryland, to fill the vacancy occasioned thereby.

On motion of Mr. Aldrich, by unanimous consent,

Ordered, That leave be granted for the withdrawal from the files of the House of the papers in the case of Basil Moreland, Isaac Andrews, and others, for the purpose of reference to one of the executive departments.

The said papers were thereupon handed to Mr. Aldrich.

Mr. Phelps, by unanimous consent, submitted the following resolution; which was read, considered, and agreed to, viz:

Resolved, That the Secretary of War is hereby requested to communicate to the House of Representatives the report of Edward F. Beale, esq., relating to the construction of a wagon road from Fort Smith, Arkansas, to the Colorado river.

Mr. John Cochrane, by unanimous consent, submitted the following resolution; which was read, considered, and agreed to, viz:

Resolved, That the Secretary of War be directed to furnish the House of Representatives the annual report of Lieutenant Colonel James D. Graham, of the topographical engineer corps, for the year 1859, on the harbor improvement for the northern and northwestern lakes.

Mr. James Craig, by unanimous consent, submitted the following resolution; which was read, considered, and agreed to, viz:

Resolved, That on Wednesday, at one o'clock, the Speaker shall call the States, commencing with the State of Maine, and upon such call members may introduce bills and resolutions of which previous notice shall have been given, for reference only, and which will not give rise to debate, and to which there is no objection.

Mr. Burch moved that the rules be suspended, so as to enable him to present the memorial of the Pacific railroad convention, held at San Francisco, California, in September, 1859.

A message from the Senate, by Mr. Dickins, their Secretary: Mr. Speaker: The Senate have passed resolutions of the following titles, viz:

S. Res. 11. A resolution for the relief of Commander H. J. Hartstene, of the United States navy ;

S. Res. 12. A resolution giving the consent of Congress to Captain William B. Shubrick to accept a sword presented to him by CaptainGeneral and President Urquiza, of the Argentine Confederation; in which I am directed to ask the concurrence of the House.

Notices were given, under the rules of motions, for leave to introduce bills as follows, viz :

By Mr. Vance: A bill to extinguish the Indian title to certain lands in North Carolina, and for other purposes.

By Mr. Ashmore: A bill to authorize the claimants in right of John Huertas to enter certain lands at any land office in the United States, being supplemental to and in enlargement of the right conferred by the act of Congress approved February 23, 1859, entitled "An act to authorize the claimants in right of John Huertas to enter certain lands in Florida."

By Mr. Vandever: A bill making a grant of lands to the State of Iowa, in alternate sections, to aid in the construction of a railroad in said State.

By Mr. William Kellogg: A bill in addition to an act to promote the progress of the useful arts.

By Mr. Reagan: A bill to amend an act entitled "An act to divide the State of Texas into two judicial districts."

By Mr. Isaac N. Morris: A bill granting to the people of the several organized Territories of the United States the right to provide, through their respective legislatures, for the appointment or election of their governors, judges, and all other territorial officers, in such mode or manner as such legislatures may by law determine;

Also, a bill authorizing the payment of the two per centum land fund to which the State of Illinois is entitled for road purposes to said State:

Also, a bill to provide for the election of postmasters throughout the United States by the people;

Also, a bill to amend the naturalization laws of the United States. By Mr. Grow: A bill to admit the State of Kansas into the Union. By Mr. Farnsworth: A bill to provide for the transportation of the mails, &c., from the Missouri river to the Pacific by railroad.

Also, a bill to authorize the Secretary of the Treasury to settle the accounts of Colonel William Gates.

The Speaker having announced as the business first in order the resolutions submitted by Mr. Sherman on Thursday last, the consideration of which was postponed until to-day, and upon which the previous question was moved

Resolved, That the House now proceed to the election of a Printer for the House of Representatives during the 36th Congress, with the proviso that the House retain the right in Congress to modify the existing law on the subject of public printing as it may see proper; the Printer who may be elected under this resolution receiving said appointment or election with and upon the condition above set forth.

Resolved, That a committee of seven be appointed by the Speaker to examine into the laws in relation to the printing for the House of Representatives, the prices paid therefor, and the duties of the Public Printer; whose duty it shall be to report thereon with the least practicable delay, together with such change or improvement therein as they may deem advisable

The question was put: Will the House agree thereto? and it was decided in the affirmative.

So the said resolutions were agreed to.
