State commission of prisons.

§ 1. The state commission of prisons shall consist of three members, to be appointed by the governor, by and with the advice and consent of the senate, the senate, and in making such appointments, the governor shall designate one of such members as president of the commission. Except as provided in this section, a member of such commission first appointed shall hold office for a term to expire on the thirtyfirst day of December, nineteen hundred and four, and a successor to such member thereafter appointed shall hold office for a term of four years, beginning on the first day of January of the year in which he is appointed. If at the time of his appointment any member of such commission holds any other state office, his term as a member of such commission shall expire on the expiration of his term as such other state officer, and his successor shall hold office for the balance of the term during which such state officer would have held, except for the foregoing limitation. Official seal. Said commission shall have power to make and use an official seal and alter the same at pleasure. Within twenty days after the amendment of this section takes effect, the governor shall appoint a state commission of prisons as herein provided, and upon the appointment and qualification of the members of such commission, the terms of the members of the commission of prisons then in office shall expire.

§ 2. Sections four and eight of chapter ten hundred and twentysix of the laws of eighteen hundred and ninety-five, entitled "An act to provide for the appointment of a state commission of prisons, and defining its duties and powers," as amended by chapter four hundred and thirty of the laws of eighteen hundred and ninety-six are hereby amended to read as follows:

§ 4. Such commission shall annually elect a secretary, who shall keep a record record of all its proceedings, and perform such duties as may be required of him by the commission and by law, and he shall receive a salary of three thousand dollars per annum; and the said commission may also appoint as employes and assistants of said commis. sion, and of the commissioners, in the performance of their official duties, a clerk, at an annual salary of one thousand five hundred dollars, a stenographer and a general office assistant, at an annual salary of one thousand dollars each, and remove each

§ 3. This act shall not affect any action or proceeding civil or Pending criminal, pending at the time of the taking effect thereof, but ete, not such action or proceeding may be prosecuted or defended in the same manner and with the same effect as if no change had been made in the organization or membership of the state commission of prisons; nor shall any provision of this act affect in any way the orders and recommendations made by, or other matters before, such commission when this act takes effect.

AN ACT to re-appropriate money for repairing armory at Os-
wego, as provided by chapter five hundred and sixty-nine of
the laws of eighteen hundred and ninety-nine.

armory in the village of Medina, Orleans county, as provided
by chapter five hundred and three of the laws of eighteen hun-
dred and ninety-nine.

The People of the State of New York, represented in Senate and
Assembly, do enact as follows:

Section 1. The balance remaining in the treasury unexpended for armory of the sum of fifty thousand dollars, appropriated by chapter five hundred and three, of the laws of eighteen hundred and ninetynine, providing for the erection of a state armory in the village of Medina, Orleans county, and for the acquisition of a site therefor, which said balance is the sum of thirty-nine thousand one hundred and sixty-eight dollars and eighty-two cents, is hereby reappropriated for the same purpose subject to the provisions of said chapter five hundred and three, of the laws of eighteen hundred and ninety-nine; and the comptroller is directed from time to time to pay the same, for the aforesaid purpose, out of any money in the treasury not otherwise appropriated, on the written requisition of the armory commission. § 2. This act shall take effect immediately.

The said corporation may, from time to time, acquire, take Acquisitior and hold a tract or tracts of land, not exceeding in the aggregate purposes. two hundred acres; which land, when acquired by said corporation, shall be used exclusively as a cemetery,-a place for the burial of the dead; and, for this purpose, it shall, from time to time, in such parcels as the trustees may deem expedient and necessary, be surveyed and subdivided into lots or plats of convenient size, and a map or maps of such survey or surveys shall be filed in the clerk's office of Niagara county. papers for the publication of the general laws of the state for
the year nineteen hundred, and for deficiency in appropriation
for the publication of the session laws and the official canvass
and official notices provided by law.

The People of the State of New York, represented in Senate and
Assembly, do enact as follows:

Section 1. The sum of forty-eight thousand five hundred dol lars, or so much thereof as may be necessary, is hereby appropriated out of any money in the treasury not otherwise appropriated, payable by the treasurer on the warrant of the comptroller, for the payment of the balance due newspapers in the various counties in this state for the publication of the general laws of the state for the year nineteen hundred, and the further sum of twenty thousand dollars, or so much thereof as may be necessary, is hereby appropriated for deficiency in appropriation for the publication of the session laws and the official canvass and official notices provided by law, which are subject to con
