The United States, in answering the memorial of His Britannic Majesty's Government in support of the claim entitled "The Kate," admits the following facts:

That the Kate was a schooner of 58.11 gross and registered tonnage, sailing under the British flag, and engaged in hunting fur seals in the North Pacific Ocean during the season of 1896; that the regulations included in the award of the Bering Sea Tribunal of 1893 were adopted and put into operation as to British vessels by the British "Behring Sea Award Act, 1894," passed April 23, 1894, by the British "Behring Sea Award Order in Council, 1894," issued April 30, 1894, and by the diplomatic arrangement between the governments of the United States and of Her late Britannic Majesty, entered into on May 11, 1894; that on the 26th day of August, 1896, while the Kate was engaged in hunting fur seals in Bering Sea, she was boarded by an officer from the United States ship Perry, one of the patrolling fleet in the North Pacific Ocean, and there being found on board two sealskins which bore evidence of having been taken by the use of firearms, in contravention of the Behring Sea Award Act, the boarding officer seized the Kate and took possession of her papers; that the Kate was thereupon taken in tow by the Perry and was brought to Unalaska, arriving there on August 29, 1896; that upon report of the seizure being made to the senior naval officer in command of the patrolling fleet, the Kate was ordered released on the ground that there was insuffi
