CHAPTER 40.

AN ACT to exempt disabled soldiers from the payment of poll taxes and from the payment of hawkers and peddlers' license fees.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. All disabled soldiers who served in the late war are hereby exempted from the payment of all poll taxes, and from the payment of all hawkers and peddlers' license fees which are now imposed by any law of this state.

SECTION 2.

This act shall take effect and be in force from and after its passage and publication. Approved March 10, 1870.

CHAPTER 41.

AN ACT to change the time of holding the terms of the circuit court in and for the seventh judicial circuit.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. The terms of the circuit court in and for the county of Waushara, in the seventh judicial circuit, shall hereafter be held on the fourth Monday in March and the second Monday in September in each year.

SECTION 2. This act shall take effect and be in force from and after its passage.

AN ACT to amend section 1 of chapter 6 of the general laws of 1868, entitled "an act to amend section 1 of chapter 133 of the general laws of 1365, entitled 'an act relating to the terms of the circuit court of the fifth judicial circuit, and amendatory of chapter 15 of the general laws of 1865.''

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section one of chapter six of the gen Amended.] eral laws of 1868, entitled "an act to amend section one of chapter one hundred and thirty-three of the general laws of 1865, entitled 'an act relating to the terms of the circuit court of the fifth judicial circuit, and amendatory of chapter fifteen of the general laws of 1865,'" is hereby amended by striking out the words, "on the fourth Monday in April," after the word, "La Fayette," in the twelfth line of said section, and inserting instead thereof the words, " on the fourth Monday in June," so that hereafter the general and special terms of the circuit court of the fifth judicial circuit shall be held as follows: in the county of Grant, on the first Monday in March and second Monday in September of each year. In the county of Iowa, on the fourth Monday in March and first Monday in October of each year. In the county of La Fayette, on the fourth Monday in June and the first Monday in December. In the county of Richland, on the second Monday in April and the fourth Monday in October, and in the county of Crawford, on the first Monday in June and the second Monday in November of each year as aforesaid.

SECTION 2. This act shall take effect and be in force from and after its passage and publication. Approved March 10, 1870.

Not lawful to construct railroad on or connect with rail

CHAPTER 43.

AN ACT to limit the uses of railroads and the power of railroad corporations on Wisconsin Point, and to prohibit the bridging of the entry of the Bay of Superior.

The people of the state of Wisconsin, represented in senate and assemblg, do enact as follows:

SECTION 1. It shall not be lawful for any person or corporation to have, construct or operate any railroad road at Wiscou on or along the strip of land known as Wisconsin Point, in Douglas county, for any purposes of connecting by that route with or receiving freight or passengers from or transferring the same to any railroad that may be constructed or operated on or along Minnesota Point, in the state Minnesota, and it shall not be lawful for any person or corporation that may hereaf ter construct or operate any railroad on or along said Wisconsin Point, by that route, to connect with or receive freight or passengers from or transfer the same to (whether by bridge, ferry or otherwise,) any railroad that shall be constructed on or along the said Minnesota Point, or to construct or use in any manner for any purpose whatever a bridge across the entry of the Bay of Superior, between said Minnesota Point and said Wisconsin Point.

AN ACT to amend section one (1) of chapter 113 of the general laws of 1867, entitled "an act in relation to tax deeds."

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

Deed not to be Whenever lot or tract of land which has been or issued without shall hereafter be sold for taxes, shall have been in the tice." actual occupancy or possession of any person other Ada than the owner and holder of the tax certificate, or those holding under him for the period of thirty days or more at any time within the six months immediately preceding the expiration of the time of redemption, or the six months immediately preceding the time when the deed shall be applied for, such deed shall not be issued unless a written notice shall have been served upon the owner or upon such occupant, by the holder of the tax certificate, at least three months prior thereto, stating that he is the holder of such certificate, and setting forth a copy thereof, and stating the time when such deed will be applied for; and at any time previously thereto or to the issuing of such deed, such lot or tract of land or any part or interest therein, may be redeemed from taxes upon the same terms as in other cases, and paying in addition one dollar for making the notice and affidavit herein required, and serving notice. An affidavit showing such service and specifying particularly the time and manner thereof, shall also be filed with the clerk of the board of supervisors before such deed shall be issued, and in no case shall any tax deed be issued upon any tax certificate, except upon proof of the service of the notice, as herein provided, or proof filed with such clerk, that the land described in such certificate of tax sale was not occupied or possessed for the period of thirty days as hereinbefore specified.

SECTION 2. All acts and parts of acts inconsistent with the provisions of this act, are hereby repealed. SECTION 3. This act shall take effect and be in force from and after its passage. Approved March 10, 1870.

CHAPTER 45.

[Published March 14, 1870.]

AN ACT to increase the penalty for trespassing upon the public lands of this state.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1 In addition to the penalties now provided by law against persons trespassing upon lands belonging to this state, also lands held on certificate and lands mortgaged to the state, or lands held in trust by the state, it is hereby provided that whenever a trespass is settled under the provisions. of the statute, the trespasser is hereby required to pay all the expenses of seizure and taking charge of the same until the settlement is completed, and the timber clerk who makes the seizure is authorized and required to collect the same, and report the amount of such charges and expenses so recovered to the school land commissioners.

SECTION 2. This act shall take effect and be in force from and after its passage.
