Present: The Chief Justice, Mr. Justice McKenna, Mr. Justice Holmes, Mr. Justice Day, Mr. Justice Van Devanter, Mr. Justice Pitney, Mr. Justice McReynolds, Mr. Justice Brandeis, and Mr. Justice Clarke.

The Chief Justice announced the following order of the court:

It is ordered that the letter of resignation of the reporter of this court, Charles Henry Butler, Esq., and the response of the court thereto be entered upon the minutes of the court as follows, to wit:

WASHINGTON, D. C., October 5, 1916. To the CHIEF JUSTICE AND ASSOCIATED JUSTICES OF THE SUPREME COURT OF THE UNITED STATES:

I hereby tender my resignation as reporter of this court, to take effect on the appointment of my successor.

I cannot do this without thanking you for the kindness and consideration which I have received from all the members of the court during the 14 terms I have had the honor of reporting their decisions. Very respectfully, your obedient servant,

DEAR SIR: In informing you of the acceptance of your resignation, we desire to convey our abiding sense of the courtesy and consideration which you have so uniformly manifested during the many years in which you have been reporter, and our appreciation of the zealous purpose to discharge fully your duty which has controlled you during that long period.

We can not refrain from hoping that the enlarged field of professional endeavor, the desire to enter upon which has caused you to sever your official relations with the court, may prove as fruitful in good results as you expect it to be, and that you may enjoy a long, happy, and useful life.

further ordered that Mr. Ernest Knaebel, of Colorado, be, and he is hereby, appointed reporter of this court in the place of Charles Henry Butler, Esq., resigned, and is charged with the duty of reporting the decisions of the present term from its commencement.
