other members of the legislature for his services as speaker of the assembly; but in case of an extra session of the legislature, no extra compensation shall be allowed.

SECTION 2. There is hereby annually appropriated a sum sufficient to be paid out of the state treasury to carry out the provisions of this chapter.

SECTION 3. This act shall take effect and be in force from and after its passage and publication. Approved February 28, 1868.

Car doors not to be locked

in motion.

CHAPTER 44.

AN ACT to prohibit the locking of car doors upon railroad trains.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. It is hereby declared to be unlawful when cars are for any officer, agent or employee of any railroad company, operating any line of railroad within this state, to lock or cause to be locked any door of any car used for the purpose of transporting passengers upon any railroad within this state, while such car is in motion and occupied by any person or persons as passengers upon said railroad, except that such car shall not be so locked as to prevent the free exit from the cars at all times. It is also hereby declared to be unlawful for any officer, agent or employee of any railroad company to use or authorize the use of any kerosene oil or other material of an explosive nature for the purpose of lighting any car used for the transportation of passengers upon any railroad in this state: provided, that said railroad companies shall have three months time to effect the changes as to the lighting their cars.

SECTION 2. Any person violating the provisions of the preceding section, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined not less than twenty-five dollars nor more than one hundred dollars.

SECTION 3. This act shall take effect and be in force from and after its passage and publication. Approved February 28, 1868.

CHAPTER 45.

AN ACT to amend chapter 165 of the revised statutes, entitled "of offences against property."

The people of the state of Wisconsin, represented in senate and assembly do enact as follows:

SECTION 1. Section eleven of chapter one hundred Amended. and sixty-five of the revised statutes is hereby amended so as to read as follows: "Section 11. Every person who shall break and enter in the night time any office, shop or warehouse, or any other building, not adjoining to or occupied with any dwelling house, or any ship, steamboat, vessel, railroad freight car or passenger car, within the body of any county, with intent to commit the crime of murder, rape, robbery, larceny or any other felony, shall be punished by imprisonment in the state prison, not more than three years nor less than one year."

SECTION 2. Section twelve of said chapter is here- Ibid. by amended so as to read as follows: "Section 12. Every person who shall enter in the night time, without breaking, or who shall break and enter in the day time any dwelling house or out house thereto, adjoining and occupied therewith, or any office, shop, warehouse or other building, or any ship, steamboat, vessel, railroad freight car or passenger car, within the body of any county, with intent to commit the crime of murder, rape or robbery, larceny or other felony, shall be punished by imprisonment in the state prison, not more than two years nor less than six months."

SECTION 3. Section fourteen of said chapter is here- Ibid. by amended so as to read as follows: "Section 14. Every person who shall break and enter in the night. time, or in the day time, any meeting-house, church,

court house, town house, college, academy or other building erected and employed for public use, and steal therein property exceeding the value of twenty dollars, or who shall commit the crime of larceny in any dwelling house, office, shop, bank, warehouse or other building, ship, steamboat, vessel, railroad freight car or pas senger car by stealing therein money or property exceeding the value of twenty dollars, shall be punished by imprisonment in the state prison, not more than three years nor less than one year, or by imprisonment in the county jail, not more than one year nor less than three months, or by fine not exceeding two hundred dollars.

SECTION 4. This act shall take effect and be in force from and after its publication. Approved February 28, 1868.

CHAPTER 46.

Repealed.

AN ACT to repeal chapter 177 of the general laws of 1867, en-
titled "
an act to repeal chapter 187 of the general laws of
1864, entitled 'an act to amend section 38 of chapter 117 of the
revised statutes, entitled 'of county courts.'"

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Chapter 177 of the general laws of 1867, entitled "an aot to repeal chapter 187 of the generan laws of 1864, entitled an act to amend section 38 of chapter 177 of the revised statutes, entitled 'of county courts," is hereby repealed, and said chapter 187 of the session laws of 1864 is hereby restored. Approved February 29, 1868.

CHAPTER 47.

AN ACT to amend sections 17 and 19 of chapter 89 of the revised statutes, entitled "of estates in dower, by the courtesy and general provisions concerning real estate.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section seventeen (17) of chapter Amended. eighty-nine (89) of the revised statutes is hereby amended so that the same shall read as follows, to wit:

If

any such jointure or pecuniary provision be made before marriage and without the assent of the intended wife, or if it be made after marriage, she shall make her election within one year after the death of her husband, whether she will take such jointure or pecuniary provision or be endowed of the lands of her husband"; but she shall not be entitled to both.

SECTION 2. Section nineteen (19) of chapter eighty- Ibid. nine (89) of the revised statutes is hereby amended so as to read as follows: When a widow shall be entitled to an election under the last preceding section, she shall be deemed to have elected to take such devise or other provision, unless within one year after the probate of her husband's will she shall commence proceedings for the assignment or recovery of her dower.

SECTION 3. This act shall take effect from and after passage and publication.

CHAPTER 48.

AN ACT to amend chapter 19 of the revised statutes, entitled "of highways and bridges."

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section twenty-five of chapter nineteen of the revised statutes, entitled "of highways and bridges," is hereby amended by inserting in the fifth line of the second clause, immediately after the word "Sheboygan," the words "Ashland, Bayfield, Burnett, Dallas, Douglas, Monroe, Polk, Marathon, Waupaca and Outagamie.'

SECTION 2. This act shall take effect after passage and publication.

Approved February 29, 1868.

Repealed.
