the county in which the business of the association shall be carried on, and a duplicate thereof shall be filed in the office of the secretary of state.

SECTION 2. Upon filing a certificate as provided in Powers of such the first section of this act, the persons who shall have corporation. signed and acknowledged such certificate, and their associates and successors shall thereupon be a body politic and corporate, by the name stated in such certificates. Said corporation shall be capable of taking, receiving, purchasing and holding, selling and disposing of real and personal estate, to make by-laws for the management of its officers, [affairs,] not inconsistent with the constitution and laws of this state or of the United States; to elect and appoint such officers and agents for the management of its business as may be deemed advisable, and to fix their term of office and the terms and qualifications of membership therein.

SECTION 3. This act shall take effect and be in force from and after its passage and publication. Approved March 4, 1868.

AN ACT to fix the time of holding the circuit court in Fond du
Lac county.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. business arising within the 4th judicial circuit which does not require the intervention of a jury may be heard and disposed of. No grand or petit jury shall be drawn or summoned for said special terms, and no notice of the holding of the same shall be required.

SECTION 3. All acts or parts of acts conflicting with or contravening any of the provisions of this act are hereby repealed, so far as they conflict with or contravene the same.

SECTION 2. This act shall take effect and be in force from and after the first day of June, 1868. Approved March 4, 1868.

AN ACT to amend section two, chapter thirty-seven of the revised statutes, entitled "of the support of bastards."

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section two (2) of chapter thirty-seven (37) of the revised statutes, entitled "of the support of bastards," is hereby amended by adding to said section at the end thereof, the words following, viz: "And the justice may adjourn the examination from time to time, for good cause shown, not exceeding ten days at one time; and in such case the accused may be recognized in a sum and with sureties to the satisfaction of the justice, for his appearance for such examination; and for want of such recognizance he shall be committed to prison."

SECTION 3. This act shall take effect and be in force from and after its passage and publication. Approved March 4, 1868.

AN ACT to authorize the state superintendent of public instruction to apportion school moneys to the town of Oxford in the county of Marquette.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. In apportioning the income of the May apportion school fund for the year 1862, the state superintendent of public instruction shall apportion to the town of Oxford, in the county of Marquette, for each district therein which has maintained school three months by a qualified teacher during the year ending August 31st, 1867.

SECTION 2. This act shall take effect and be in force from and after its passage and publication. Approved March 4, 1868.

AN ACT to amend chapter 77 of the general laws of 1866, entitled 66 an act for the regulation of trade in certain cases, and chapter 21 of the general laws of 1867, entitled an act to amend [sections] five, nine, ten and eleven, of chapter 77 of the general laws of 1866, entitled an act for the regulation of trade in certain cases, and in addition to said act.'"

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section 2 of chapter 77 of the general Amended laws of 1866, is hereby amended by striking out the word "shall," in the first line thereof, and inserting in lieu thereof the word "may."

SECTION 2. Section 5 of chapter 21 of the general bi laws of 1867, is hereby amended so as to read as follows: Section 5. Hereafter no fresh water fish packed 6 GEN. LAWS.

in barrels or other packages as provided in this act, or in the act of which this is amendatory, shall be sold or offered or exposed for sale, without having been duly inspected and branded by the state inspector of fish, or one of his duly appointed deputies, and any person who shall sell or offer or expose for sale, any such fish before the same shall have been inspected and branded as aforesaid, shall be guilty of a misdemeanor, and shall forfeit a sum not less than fifty cents nor more than five dollars for each barrel or package of fish so sold or offered or exposed for sale: provided nevertheless, that fishermen may sell or dispose of any fish actually taken by them to dealers at any lake port within this state, without inspection; but after any fish shall have been once sold or disposed of by such fishermen, the same shall not be again sold, or offered, or exposed for sale, or disposed of without inspection, as aforesaid, except that all fish exported to lake ports out of thisstate shall not be subject to inspection.

SECTION 3. Section 6 of chapter 21 of the general laws of 1867, is hereby amended so as to read as fol· lows: Section 6. It is hereby made the duty of every consignee of any fresh water fish, packed in the manner provided in this act, or in the act of which this act is amendatory, if such fish have not been previously inspected, to have such inspection made before offering the same for sale or making any delivery thereof to the owner or his agent, or to any other person. Any person violating the provisions of this section shall be deemed guilty of a misdemeanor, and shall be punished as provided in section five.

SECTION 4. Section 3 of chapter 21 of the general laws of 1867 is hereby amended by striking out the words "ninety" and "fifty" where they occur, and inserting in lieu thereof respectively the words "seventyfive" and "forty-five."

SECTION 5. Anything in either of the chapters of which this chapter is amendatory which is inconsistent with the provisions of this chapter is hereby repealed. SECTION 6. This chapter shall take effect and be in force from and after its passage and publication. Approved March 4, 1868.

AN ACT to authorize the state superintendent of public instruction to apportion school moneys to the towns of Vinland, Clayton and Neenah, in the county of Winnebago.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. The state superintendent of public in- Shall apportion struction in apportioning the income of the school fund moneys. in the year 1868, shall apportion to the towns of Vinland, Clayton and Neenah, in the county of Winnebago, the amount the said towns would have been entitled to if joint school district No. one therein had maintained a school for five months during the year ending August 31st, 1867.

SECTION 2. The town clerks of the said towns of Vinland, Clayton and Neenah shall, during the year 1868, apportion to joint district No. one thereof the full sum of money said district would have been entitled to, if the report of the clerk of said district for the year 1867 had shown that a school had been maintained therein, by a qualified teacher, for five months during the year covered by such report.

SECTION 3. This act shall take effect and be in force from and after its passage and publication. Approved March 4, 1868.
