AN ACT to authorize the trustees of the village of
Dansville, Livingston county, to levy a tax to pay
a reward offered by said trustees in July, 1851.

The People of the State of New York, represented in
Senate and Assembly, do enact as follows:

1. The trustees of the village of Dansville, Livingston Money to be county, are hereby authorized to raise, by tax on the real and personal property in said village, in the manner that other village taxes are now raised by law, the sum of two hundred dollars, to pay a reward offered by said trustees in July, one thousand eight hundred and fifty-one, for the arrest and conviction of certain incendiaries.

$2. This act shall take effect immediately.

AN ACT to amend the act entitled "An act to consolidate and amend the act to incorporate the city of Buffalo, passed April 20, 1832, and the vari ous acts amendatory thereof," passed April 17,

1843.

S22. The common council is hereby authorized and empowered to purchase real estate in the city of Buffalo, with or without buildings thereupon, and to pay therefor a sum not exceeding one hundred thousand dollars, which real estate shall be conveyed to said city for its corporate use; and, for the purpose of paying for said real estate, the common council may on the credit of said city borrow a sum of money not exceeding one hundred thousand dollars, for a term not exceeding twenty years, and at a rate of interest not more than seven per cent. per annum, and execute the bonds of said city therefor, under its corporate seal and the signature of the mayor, or such other officer of the corporation as the common council may designate; the said bonds shall be in the sums, and payable at the place or places, and the time or times, and in such form as said common council shall direct.

$23. The common council may deliver the bonds, exeBonds to be cuted as provided in the preceding section, to any person or persons from whom such real estate shall be purchased, which bonds may be delivered in payment of the purchase money of said real estate; or in case the common council shall deem it more advantageous to the city, such common council may sell said bonds to any person or persons, corporation or corporations, and upon such terms as the common council may deem advisable, not less than par, and the money arising from such sale of said bonds shall be applied by said common council in paying for said real estate.

$24. The common council shall cause the real estate or Public park a portion thereof, when purchased as aforesaid, to be converted into a public park or ground, and if such common council deem it expedient, said real estate or a part thereof may be used for the purpose of erecting, altering or repairing upon the same the requisite building or buildings into suitable halls, rooms, offices, or chambers, for the use and accommodation of the corporate officers of said city.

Chap. 12.

AN ACT to amend an act entitled "An act to provide for a supply of water in the village of Newburgh," passed March 30, 1852, and to confirm the proceedings of the water commissioners, trus tees and electors of said village, under said act. Passed February 23, 1853, three-fifths being present. The People of the State of New York, represented in Senate and Assembly, do enact as follows:

$1. The eighth section of an act, entitled "An act to provide for a supply of water in the village of Newburgh," passed March 30, 1852, is hereby amended so as to read as follows:

The said commissioners are hereby authorized to enter Surveys. in and upon any land or water, for the purpose of making surveys, and to agree with the owner or owners of the property, real or personal, which may be required for the purposes of this act, or which may be injuriously affected by any operation connected therewith, as to the amount of compensation to be paid to such owner or owners; or said commissioners may agree with any owner of land for the purchase of, or the easement in any lands and real estate, or for the taking of any water, and any such acquisition of land or right therein, or any water, shall be held for the purposes of this act.

$2. The ninth section of said act is hereby amended so as to read as follows:

In case of disagreement between the said commisioners and the owner or owners of any property which may be required for the purposes of this act, or which may be injuriously affected by any operation connected therewith, as to the amount of compensation to be paid to such owner or owners, or in case any such owner shall be an infant, or married woman, or insane, or absent from the state, or unknown, or the owner of a contingent or uncertain interest, the supreme court, at any general or special term in the second judicial district, shall, upon the application of either party, af ter ten days' personal notice, or, when such notice cannot be served within this state, after three weeks' notice of said application published in all of the newspapers of the village of

Newburgh, nominate and appoint three disinterested persons as commissioners to examine such property, who, upon being duly sworn faithfully and impartially to discharge their duties, shall estimate and report to the said court the several sums which will be a just compensation to such owners respectively for the appropriation, to the purposes of this act, of any property or easement therein which may be so required, or from any damages to be sustained by any person or persons by reason of taking directly or injuring any water or water-courses, or for the use of any property, temporarily or otherwise, in the construction and maintenance of the works authorized to be constructed under this act, as the case may be, or if any.

$3. The tenth section of this act is hereby amended so as to read as follows:

Whenever such report shall have been confirmed by the supreme court, either at a general or special term, in the second judicial district, the said water commissioners may deposit or invest, as said court may direct, or pay to said owner or owners, or to such person or persons as the said court may direct, the sum mentioned in said report, in full compensation for all damages sustained by such owner or owners, or such person or persons; and thereupon the trustees of the village of Newburgh shall take, hold and enjoy such property, easements and rights, for the purposes of this act.

4. The twelfth section of said act is hereby amended by striking out the word "clerk" therein, and in place of such word inserting the word "treasurer.

$5. The twenty-first section of said act is hereby amended by striking out the word "more" therein, and inserting in place of such word the word "less."

$6. The said act is hereby further amended by repealing the thirtieth, thirty-first and thirty-second sections thereof, which are hereby repealed.

$7. All acts and parts of acts heretofore passed, inconsistent with the said act as hereby amended, is hereby repealed.

$8. All the proceedings of the water commissioners, the trustees, and the electors of the village of Newburgh aforesaid, under the act hereby amended, for the purpose of supplying said village with a sufficient quantity of pure and wholesome water, are hereby confirmed, and declared as valid as the same would have been if such proceedings

had been taken within the time required by the said act hereby amended.

$9. This act shall take effect immediately.

Chap. 13.

AN ACT to authorize the annual election of a Board of Commissioners of Excise in the city of Oswego.

Passed February 25, 1853.

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

$1. The inspectors of election of the several election districts in said city shall provide a ballot-box, to be marked "Excise." All the ballots for commissioners of excise shall be endorsed "Excise," and shall be deposited in said box; and no other officers shall be voted for on said ballots. The election and canvass of votes shall be conducted in the same manner as is prescribed for the election of city officers by the act to incorporate said city; and the commissioners. elected shall severally qualify in like manner as directed by section thirteen of title two of said act. In case of a vacancy in the office of any or either of said commissioners, from a neglect to choose, or any other cause, a special elcction to supply the same shall be directed by the common council, and shall be held and conducted in like manner as the annual election.
