and fifteen cents, to be paid to Julius M. Perryman, of said 108th Company of U. S. Coast Artillery, as his pay for the month of April, 1904, and having in violation of said trust converted said sum to his own use and benefit, and failed to pay said sum to the said Perryman until on complaint of the said Perryman investigation of the matter was commenced on or about May 25, 1904, by Lieutenant Colonel Daniel H. Brush, inspector general, U. S Army, did, about 2 o'clock p. m. of said last mentioned date, enter the squad room of the 38th Company, U. S. Coast Artillery, in the said Cuartel de Espana, and in presence of enlisted men in order to pay said sum obtain a loan of fifteen dollars from Private John P. Braun, of said company, against the expressed wishes of the said Braun, using his official position therefor, and promising therefor to return said sum to the said Braun at four o'clock p. m. of the same day, which promise he failed to execute though so requested thereafter by the said Braun."

ADDITIONAL CHARGE.-"Conduct unbecoming an officer and gentleman, in violation of the 61st Article of War." Specification 1st-"In that First Lieutenant Harry J. Collins, 28th U. S. Infantry, having obtained a loan of one hundred dollars, U. S. currency, from Mr. C. M. Monasmith, on or about April 7, 1904, the same to be paid at the expiration of one month from said date, he, the said Collins, knowing that the said Monasmith had borrowed the money for him, the said Collins, on the express condition that payment would be made as promised, did nevertheless fail to pay said sum as promised and has ever since fraudulently evaded payment thereof. This at Manila, P. I."

Specification 28-"In that First Lieutenant Harry J. Collins, 28th Infantry, being justly indebted to Mr. J. K Brown, in the sum of twenty seven dollars, U. S. currency, and having repeatedly failed in his promises to make payment thereof, and having again on or about May 21, 1904, promised to pay said sum to the said J. K. Brown on May 23, 1904, did nevertheless fail to pay said sum on said mentioned date and thereafter. This at Manila,

Specification 3d-"In that First Lieutenant Harry J. Collins, 28th U. S. Infantry, being justly indebted to the Pacific Oriental Trading Company of Manila, P. I, on or about March 8, 1904, for the sum of one hundred and ten dollars and fifty cents, U. S. currency, which said sum he, the said Collins, promised to pay on or before March 15, 1904, and having failed in fulfilling said promise, did again promise to pay said sum on May 1, 1904, and having failed in fulfilling said last mentioned promise, did again promise to pay said sum on May 23, 1904, has nevertheless ever since failed to pay said sum to said Pacific Oriental Trading Company. This at Manila, P. I."

To which charges and specifications the accused pleaded as follows:

To the 1st Specification, “Not guilty."
To the 2d Specification, "Not guilty."

"Not guilty."

Of the 2d Specification, "Guilty, excepting the words 'against the expressed wishes of the said Braun, using his official position therefor,' and of the excepted words not guilty."

And the court does therefore sentence the accused, First Lieutenant Harry J. Collins, 28th Infantry, "To be dismissed! the service of the United States."

The record of the proceedings of the general court-martial in the foregoing case of 1st Lieutenant Harry J. Collins, 28th Infantry, having been submitted to the President, the following are his orders thereon:

WHITE HOUSE, September 10th, 1904.

In the foregoing case of First Lieutenant Harry J. Collins, 28th Infan try, U. S. Army, the sentence is confirmed and will be duly executed. THEODORE ROOSEVELT.

Lieutenant Collins ceases to be an officer of the Army from September 15, 1904.

Before a general court-martial which convened at the Presidio of San Francisco, California, pursuant to Special Orders, No. 160, Department of California, July 22, 1904, and of which Colonel CHARLES MORRIS, Artillery Corps, was president, and Captain JOHN J. BRADLEY, 14th Infantry, judge advocate, were arraigned and tried the following-named officers:

I. Second Lieutenant William W. White, 18th Infantry. CHARGE I.-"Conduct unbecoming an officer and a gentleman, in violation of the 61st Article of War."

(Four specifications.)

CHARGE II.-"Absence without leave, in violation of the 62d Article of War."

(Two specifications.)

To which charges and specifications the accused pleaded as follows:

And the court does therefore sentence him, Second Lieutenant William W. White, 13th Infantry, "To be dismissed the service of the United States."
