The officers of the retired list of the Army hereinafter named, having been duly nominated to the Senate for advancement in grade and the Senate having advised and consented, on December 16, 1904, to their advancement, are placed upon the retired list of the Army by the President, with the rank and date of rank specified in each case, under the provisions of the act of Congress approved April 23, 1904. The Attorney General having expressed the opinion that "Advancement on the retired list such as is authorized by the act of April 23, 1904,

es not create an office and is not accomplished by an exercise of the appointing power," no appointments or commissions can be given to the officers advanced in grade under the provisions of the act cited.
