MILTON SUTLIFF succeeded Hon. JOSIAH SCOTT as Chief Justice, Feb. 9, 1862, when the latter entered upon a new term of five years. (iii) ORDER OF COURT. THE following order is copied from the journal of December term, 1861. "The Court being of the opinion that for volume twelve, Ohio State Reports, to contain all the cases decided at the present term for report, the volume would thereby be too large, do, therefore, direct the Reporter not to put into said volume more than about seven hundred pages, so as to preserve uniformity, as near as may be practicable, in the size of the volumes, and to reserve the remainder of the cases for the next volume." NOTE. It was found to be impossible to get all the cases of the term, for report, into this volume (even by omitting the points made by counsel in argument), without enlarging it much beyond its present size.
