PREFACE.

THE learned Author described the Work in his Preface to the Third Edition as "a convenient digest of the leading principles of the law of contracts as derived from judicial exposition." The present Edition has been prepared on the same lines. Considerations of space prevented the inclusion of all the modern decisions on each branch of the law dealt with, but I do not think I have omitted any case of real importance. The cases reported down to date have been considered.

The most material alteration is in that portion which deals with contracts in restraint of trade. This I was compelled to re-write, making the decision of the House of Lords in Nordenfeldt v. Maxim Nordenfeldt Gun and Ammunition Co. the point of departure. Of the general accuracy of the Author's work I can give a striking instance. The decision of the Court of Appeal in Durant v. Roberts necessitated a serious modification of the text, but upon the reversal of that decision in the House of Lords I had to restore the original text with an immaterial verbal alteration.
