tain from any such insurance company, or any agent thereof, the amount of such insurance, or shall falsely obtain, cause to be obtained or attempt to obtain from any such life or accident insurance company, any sum of money, upon any life or accident policy of such company, by means of false and fraudulent written representations, an affidavit falsely representing that the person whose life was insured was dead, or that the person insured against accident was injured; every person so offending shall be deemed guilty of a misdemeanor, and, on conviction thereof, if the sum so obtained, attempted or caused to be obtained, shall be equal to or exceed the sum of twenty-five dollars, shall upon conviction thereof, be imprisoned at hard labor in the state prison, for a period not less than one year nor more than fifteen years; and if the sum so obtained, caused or attempted to be obtained, shall be less than twenty-five dollars, the person so offending shall, on conviction thereof, be fined in any sum, not more than five hundred dollars, or be imprisoned in the county jail of the proper county for a period not exceeding six months, or both, at the discretion of the court.

SECTION 2. This act shall take effect and be in force from and after its passage. Approved February 8, 1868.

AN ACT to provide for the auditing and payment of the postage of the members and officers of the senate and assembly, and state officers.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Chapter one of the general laws of Amended, 1858, entitled "an act for the auditing and payment of the postage of the members and officers of the senate and assembly, and state officers," (be and the same) is hereby repealed.

SECTION 2. This act shall take effect and be force from and after its passage and publication. Approved February 11, 1868.

CHAPTER 16.

AN ACT to repeal chapter nine of the general laws of 1862, entitled "an act to amend chapter two hundred and seventy-six of the general laws of 1861, entitled 'an act to amend chapter twentytwo of the general laws of 1859, entitled 'an act relative to the sale of lands for unpaid taxes, and the conveyance and redemption thereof.""

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Chapter nine of the general laws of 1862, entitled "an act to amend chapter two hundred and seventy-six of the general laws of 1861, entitled an act to amend chapter twenty-two of the general laws of 1859, entitled an act relative to the sale of lands for unpaid taxes, and the conveyance and redemption thereof,"" is hereby repealed.

SECTION 2. This act shall take effect and be in force from and after its passage and publication. Approved February 12, 1868.

CHAPTER 17.

AN ACT relating to the selection of jurors.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section 2 of chapter 112 of the general

lows: "Hereafter the board of supervisors in each. county in this state, to which this act shall be applicable, in making up the jury list for such county shall select the names of the persons chosen as jurors from the several lists returned to the clerk of the board of supervisors in compliance with this act : provided, that when through the neglect of one or more town boards of supervisors, boards of trustees or boards of aldermen, to make out and return to the clerk of the county board of supervisors a list or lists of names in compliance with this act, the whole number returned shall be insufficient, such county board of supervisors shall supply the deficiency by selecting, as nearly as practicable, an equal number of names from each of the poll lists of the last general election in such towns, villages and wards as shall have failed to return jury lists in accordance with this act; and provided further, that the county board shall select from the poll lists only such men as they know to be qualified to serve as jurors.

SECTION 2. It shall be the duty of the clerk of the county board of supervisors in each county in which of board the entire jury lists for the year 1868 have not been made out, to call a meeting of such board within ninety days after the passage of this act for the purpose of filling out their jury lists as provided therein. SECTION 3. This act shall take effect and be in force from and after its passage and publication. Approved February 13, 1868.

CHAPTER 18.

AN ACT to amend section three of chapter one hundred and seventy-nine of the general laws of 1867, entitled "an act to regulate insurance companies not incorporated by the state of Wisconsin."

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section 3 of chapter 179 of the general Amended: laws of 1867, entitled "an act to regulate insurance

companies not incorporated by the state of Wisconsin," is hereby amended by inserting after the words "offi cial state paper," in the fifteenth line of the printed. section three (3) of said law, the words "and one daily paper of general circulation published in the city of Milwaukee."

SECTION 2. This act shall take effect and be in force from and after its passage and publication. Approved February 14, 1867.

CHAPTER 19.

AN ACT to amend section three (3) of chapter eighty-five (85,) of the laws of 1867, entitled "an act relating to the return and canvass of votes.

The people of the state of Wisconsin, represented in senate and assembly do enact as follows:

SECTION 1. Section three (3) of chapter eighty-five (85,) of the laws of 1867, is hereby amended by adding thereto the following: "and any town, ward, or election district causing the necessity of sending out such messenger, shall defray all the expense incurred thereby, and shall be charged therefor by the county board of supervisors.

CHAPTER 20.

AN ACT to amend chapter 518 of the general laws of 1865, entitled 66 'an act to dedicate a strip of land along the west line of the prison grounds for a public street."

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

SECTION 1. Section one of chapter 518 of the general laws of 1865, entitled "an act to dedicate a strip of land along the west line of the prison grounds for a public street," approved June 2d, 1865, is hereby amended so as to read, "twenty-five feet," instead of "three rods," wherever these words occur, so that said section, when so amended, will read as follows: "Section 1. The state prison commissioner is hereby authorized and required, as soon as may be convenient, to remove the west line of the fence along the prison grounds so far east that said fence will stand in a straight line with the east line of Drummond street as laid down in the recorded plat of the village of East Waupun, and the piece of land so set apart is hereby dedicated to be used as a public street: provided, that previous to the removal of said fence, the owners of the premises along the west line of said grounds shall also dedicate a piece of land for the same purpose sufficient with the land so set apart to make said street not less than twenty-five feet wide: provided further, that the commissioner shall have no authority to remove such fence until the owners of land next south of the prison grounds, or (to) the authorities of the village of Waupun shall set apart and forever dedicate to the public as a highway, a strip of land twenty-five feet wide along the south line of the prison grounds, connecting Madison street with Drummond street as so extended."

SECTION 2. This act shall take effect and be in force from and after its passage.
