AN ACT

IN RELATION TO COUNTY SUPERINTENDENTS OF SCHOOLS.

Be It Enacted by the General Assembly of the State of Colorado:

Section 1. For the purpose of regulating the amount of compensation for county superintendents of schools, the counties of the state are divided into seven classes as follows: The first class shall consist of the counties of El Paso, Las Animas, Pueblo and Weld; the second class shall consist of the counties of Boulder, Fremont, Garfield, Larimer and Mesa; the third class shall consist of the counties of Adams, Chaffee, Delta, Gunnison, Huerfano, Logan, Montrose, Morgan, Otero, Prowers and Routt; the fourth class shall consist of the counties of Alamosa, Arapahoe, Cheyenne, Conejos, Costilla, Crowley, Douglas, Eagle, Elbert, Kit Carson, Washington, Yuma, Gilpin, Jefferson, Phillips, Ouray, Lake, Lincoln, Teller, Rio Grande, Park, Pitkin, Rio Blanco, Saguache and San Miguel; the fifth class shall consist of the counties of Archuleta, Clear Creek, Baca, Custer, the City and County of Denver, Grand, Jackson, Kiowa, La Plata, Moffat, Montezuma, Sedgwick and Summit; the sixth class shall consist of the counties of Mineral and San Juan; the seventh class shall consist of the counties of Dolores and Hinsdale.

Sec. 2. The county superintendents of schools shall receive annual salary, payable monthly out of the county

treasury, as follows: In counties of the first class, an annual salary of two thousand, eight hundred dollars ($2,800); in counties of the second class, two thousand dollars ($2,000); in counties of the third class, one thousand, five hundred dollars ($1,500); in counties of the fourth class, one thousand, one hundred dollars ($1,100); in counties of the fifth class, nine hundred dollars ($900); in counties of the sixth class, five hundred dollars ($500); in counties of the seventh class, one hundred dollars ($100).

Sec. 3. The board of county commissioners shall Mileage. also allow to the county superintendent mileage not to exceed ten cents per mile for the distance necessarily and actually traveled in the performance of duty, not to exceed an aggregate of two hundred dollars per annum.

Sec. 4. Section 2575 of the Revised Statutes of 1908 Act repealed. and all other acts and parts of acts in conflict with this act are hereby repealed.

AN ACT

CONCERNING THE SALARIES OF DEPUTY DISTRICT ATTOR-
NEYS AND TO AMEND SECTION 2584 OF THE REVISED
STATUTES OF THE STATE OF COLORADO, 1908.

Be It Enacted by the General Assembly of the State of Colorado: Section 1. That section 2584 of the Revised Statutes of the State of Colorado, 1908, be and the same is hereby amended so as to read as follows:

Section 2584. That the deputies of the district attorneys shall be entitled to such compensation for services rendered by them in any county as the judges of the District Court, or a majority of them in a district wherein such county is situate, may direct, not exceeding the sum of $2,000 annually to each deputy, payable out of the fees of the office of the district attorney; Provided, That in counties having a population of over one hundred thousand (100,000) two of such deputies may receive not to exceed the sum of $2,400 annually, payable as aforesaid. AN ACT

CONCERNING SALARIES OF SHERIFFS, UNDER-SHERIFFS AND DEPUTY SHERIFFS AND TO AMEND SECTIONS 2571 AND 2580 OF REVISED STATUTES OF 1908.

Be It Enacted by the General Assembly of the State of Colorado:

Section 1. That section 2571 of the Revised Statutes Act amended. of 1908 shall be, and the same is hereby amended to read as follows:

Section 2571. The sheriffs in the several counties of this state shall receive as their only compensation for their services rendered, an annual salary to be paid quarterly out of the fees, commissions and emoluments of their respective offices and not otherwise, to-wit: In counties of the first class, the sum of forty-six hundred dollars ($4,600). In counties of the second class, the sum of three thousand dollars ($3,000). In counties of the third class, the sum of twenty-eight hundred dollars ($2,800). In division "A" of counties of the fourth class, the sum of twenty-three hundred dollars ($2,300). In division "B" of counties of the fourth class, the sum of seventeen hundred dollars ($1,700). In counties of the fifth class, the sum of fifteen hundred dollars ($1,500). Sheriff's shall be allowed actual traveling expenses, payable out of the county treasury, upon verified, itemized account being presented for the same; in the service of all warrants, capiases, mittimuses, commitments, body attachments and

court orders, requiring same, not to exceed ten cents per mile in counties not of the first class; Provided, however, That the actual expenses incurred in the service of executions, writs of attachment, replevins, restitutions or other process not hereinbefore mentioned, shall be paid by the party requiring such service. In counties of the first class, the under-sheriffs and deputy sheriffs appointed by the sheriff shall be paid a salary; the under-sheriffs, the sum of two thousand five hundred dollars ($2,500) per annum; and each deputy, the sum of fifteen hundred dollars ($1,500) per annum, excepting the deputy acting as chief clerk, and chief criminal deputy, who shall each receive the sum of eighteen hundred dollars ($1,800) per annum. In counties of the second class the under-sheriffs and the deputy sheriffs appointed by the sheriff shall be paid a salary out of the general funds of the county, the under-sheriffs the sum of eighteen hundred ($1,800) dollars per annum, and each deputy sheriff the sum of twelve hundred dollars ($1,200) per annum. In counties of the third class the under-sheriff and a deputy sheriff appointed by the sheriff shall be paid a salary, as hereinafter provided, out of the general funds of the county; and other deputy sheriffs appointed by the sheriff, under the direction of the board of county commissioners of the county, shall be paid a salary out of the fees, commissions and emoluments of the office, as hereinafter provided. The under-sheriffs not to exceed the sum of eighteen hundred dollars ($1,800) per annum, and each deputy not to exceed the sum of twelve hundred dollars ($1,200) per annum; Provided, however, That bailiffs of county courts, or deputy sheriff's acting in such capacity in counties of the first class, shall receive the same compensation as bailiffs of the district courts, or deputy sheriffs acting in such capacity in counties of the first class. The undersheriff and each and every deputy sheriff shall make to the sheriff a report in writing under oath, of all fees collected of any description whatsoever and of all expendi tures and necessary expenses pertaining to and relative to the discharge of the duties of his office.
