NOTE. In the case of Whitesides vs. Caldwell, page 421, it-is stated that "the judgment was reversed, and the cause remanded." This was the original order of the court, but on further reflection, the court was of opinion they ought to render such judgment upon the demurrer as the circuit court ought to have given, and final judgment was accordingly rendered in favor of the defendant.-[REPORTER.]
