With respect to licensing this includes the receiving and reviewing of applications for original licenses, extensions of route, and raise of grade or renewals; passing on the professional qualifications of applicants; compiling examinations; giving examinations to applicants; grading examinations; and awarding licenses to successful applicants. With respect to staff officers on merchant vessels, receive applications and issue certificates of registration to eligible applicants. With respect to seamen, receive applications and issue continuous discharge books or certificates of identification as a Merchant Mariner's Document to eligible applicants, as well as to perform activities relating to the issuance of certificates of service or efficiency, including the receiving of applications, passing on the eligibility of applicants, giving oral or written and practical examinations, when required by law, and issuing appropriate certificates in the form of Merchant Mariner's Documents or making appropriate endorsements on such documents. In addition, forward applications for seamen's documents for security screening; perform other activities relating to licensing and certificating as required, including the issuance of validated security documents. 2-3-40. SHIPMENT AND DISCHARGE SECTION

Under the general superintendence of the officer in charge, marine inspection, the Shipment and Discharge Section is responsible for those activities which

relate to the shipment and discharge of seamen; the arbitration of disputes between the master and crews when properly authorized; the receipt and disposition of the wages and effects of deceased seamen as directed by the Federal Court having jurisdiction; and the performance of other activities related to the shipment and discharge of merchant marine personnel.

2-3-45. INVESTIGATIVE SECTION

Under the general superintendence of the officer in charge, marine inspection, the Investigative Section is responsible for those activities which relate to the investigations of cases of alleged acts by licensed and certificated members of the merchant marine which might warrant the suspension or revocation of the license or certificate issued by the Coast Guard; initiate and carry the prosecution of actions against merchant marine personnel at hearings before examiners; conduct investigations of casualties in order to determine the cause of the accident and whether materiel or personnel was at fault; and the performance of other activities pertaining to investigating of merchant marine matters as required.

PART 2-4--PERSONNEL

2-4-1. RESPONSIBILITY OF COAST GUARD PERSONNEL

Merchant marine safety functions are based on the navigation and vessel inspection laws. While command responsibility rests primarily on the Commandant, the district commanders, and the officers in charge, marine inspection, this does not relieve officers and civilians assigned to perform merchant marine safety duties of performance responsibility with respect to assigned duties. The statutory provisions in R.S. 4425 (46 U.S.C. 403), regarding punishment for certifying falsely, R.S. 4448 (46 U.S.C. 234), regarding disclosure of information, and 18 U.S.C. 1912, regarding taking illegal fees, apply equally to military and civilian personnel in the Coast Guard.

2-4-5. SECRETARY OF THE TREASURY

The Secretary of the Treasury (or the Secretary of the Navy when the Coast Guard is in the Navy) is responsible for the administration of the navigation and vessel inspection laws. The Secretary of the Treasury has delegated the se duties pertaining to merchant marine safety to the Commandant of the Coast Guard, subject to his general supervision.

2-4-10. COMMANDANT OF THE COAST GUARD

The Commandant has complete command responsibility for the administration and enforcement of the navigation and vessel inspection laws with respect to merchant marine safety insofar as such duties have not been vested or

delegated to other Federal agencies. In turn, the Commandant has partially delegated this responsibility and the performance of certain functions to the district commanders and to the officers in charge, marine inspection. 2-4-15. DISTRICT COMMANDER

The district commander has been delegated general authority over and responsibility for the administration and enforcement of the laws, rules, and regulations relating to navigation and vessel inspection within his district, which include inspections, enforcement, and administration of Title 52, Revised Statutes, and acts amendatory thereof or supplementary thereto, and rules and regulations thereunder. The district commander has command responsibility in the performance of assigned merchant marine safety duties.

2-4-20. MARINE INSPECTION OFFICER

Under the general direction and supervision of the district commander and his chief of staff, the marine inspection officer is the chief of the merchant marine safety division in the district office. The marine inspection officer is a staff officer for the district commander. The marine inspection officer is responsible to the district commander for the performance of merchant marine safety activities within the Coast Guard district. The marine inspection officer is designated in writing by the Commandant (P).

2-4-25. OFFICER IN CHARGE, MARINE INSPECTION (OCMI)

Under the superintendence of the district commander, the officer in charge,

marine inspection, has command responsibility within an assigned marine inspection zone for the performance of duties with respect to the inspections, enforcement, and administration of Title 52, Revised Statutes, and acts amenda tory thereof or supplemental thereto, and rules and regulations thereunder. The officer in charge, marine inspection, is in charge of a marine inspection office and is responsible to the district commander and the Commandant for the initial performance of merchant marine safety duties assigned. The officer in charge, marine inspection, has been designated by the Commandant (P) and delegated to give immediate direction to Coast Guard activities relating to merchant marine safety within the general proximity of the port in or near which he is situated. The officer in charge, marine inspection, is authorized and delegated authority to perform all duties assigned to a marine inspection office. The officer in charge, marine inspection, may be a person from the civilian or military branch of the Coast Guard and is designated by the Commandant or Assistant Commandant. This designation "Officer in Charge, Marine Inspection,'' confers special authority and responsibilities relative to merchant marine safety functions in a specific geographical area, and command authority and responsibility to a degree commensurate with the status of the person so designated. Thus, if a commissioned officer, the person designated "Officer in Charge, Marine Inspection," becomes simultaneously a commanding officer; if not a commissioned officer, he becomes an officer-in-charge.

2-4-27. ACTING OFFICER IN CHARGE, MARINE INSPECTION (AOCMI)

In the official absence of an officer in charge, marine inspection, then the senior inspector, materiel, shall be in charge and act as "Acting Officer in Charge, Marine Inspection." In the offi

cial absence of both the officer in charge, marine inspection, and the senior inspector, materiel, the district commander shall designate a responsible marine inspector to be in charge and act as "Acting Officer in Charge, Marine Inspection." The district commander's designation of a marine inspector to act as "Acting Officer in Charge, Marine Inspection,'' shall be in writing, limited to a specific period of time, and a copy of such a designation shall be forwarded to the Commandant (M) for information.

2-4-30. SENIOR INSPECTOR, MATERIEL (SIM)

The senior inspector, materiel, under the direction of the officer in charge, marine inspection, is responsible for the immediate supervision of those merchant marine safety activities pertaining to materiel inspection. The senior inspector, materiel, is the chief of the materiel inspection section in the marine inspection office. The senior inspector, materiel, is designated in writing by the Commandant (P) from the civilian or military branch of the Coast Guard. During an official absence of the officer in charge, marine inspection, the senior inspector, materiel, becomes "Acting Officer in Charge, Marine Inspection."

2-4-35. SENIOR INSPECTOR, PERSONNEL (SIP)

The senior inspector, personnel, under the direction of the officer in charge, marine inspection, is responsible for the immediate supervision of those merchant marine safety activities pertaining to licensing and certificating of seamen. The senior inspector, personnel, is the chief of the licensing and certificating section in the marine inspection office. The senior inspector, personnel, is designated in writing by the Commandant (P) from the civilian or military branch of the Coast Guard

2-4-40. SENIOR SHIPPING COMMISSIONER (SSC)

The senior shipping commissioner, under the direction of the officer in charge, marine inspection, is responsible for the immediate supervision of those merchant marine safety activities pertaining to shipment and discharge of seamen. The senior shipping commissioner is chief of the shipment and discharge section in the marine inspection office. The senior shipping commissioner is designated in writing by the Commandant (P) from the civilian or military branch of the Coast Guard.

2-4-45. SENIOR INVESTIGATING OFFICER (SIO)

The senior investigating officer, under the direction of the officer in charge, marine inspection, is responsible for the immediate supervision of those merchant marine safety activities pertaining to investigations of merchant marine personnel, marine casualties, and marine accidents, initiation and prosecution of actions against merchant marine personnel in hearings before examiners, and other related activities pertaining to investigations. The senior investigating officer is chief of the investigating section in the marine inspection office. The senior investigating officer is designated in writing by the Commandant (P) from the civilian or military branch of the Coast Guard.

2-4-47. MARINE INSPECTOR OR INSPECTOR (MI)

With respect to merchant marine safety, a marine inspector or inspector means any person from the civilian or military branch of the Coast Guard assigned under the superintendence and direction of an officer in charge, marine inspection, or any other person as may be designated for the performance of duties with respect to the inspection, enforce

ment, and administration of Title 52, Revised Statutes, and acts amendatory thereof or supplemental thereto, and rules and regulations thereunder. 2-4-50. MATERIEL INSPECTOR, HULL (H)

A materiel inspector, hull (H), means a person who is fully qualified to perform hull inspections of merchant vessels in compliance with applicable laws, regulations, and directives.

2-4-53. MATERIEL INSPECTOR, BOILER (B)

A materiel inspector, boiler (B), means a person who is fully qualified to perform machinery inspections of merchant vessels in compliance with applicable laws, regulations, and directives. 2-4-55. MATERIEL INSPECTOR, ELECTRICAL (E)

A materiel inspector, electrical (E), means a person who is fully qualified to perform inspections of electrical installations and equipage on merchant vessels from the standpoint of accepted practice and in compliance with applicable laws, regulations, and directives. 2-4-57. INVESTIGATING OFFICER (IO)

An investigating officer (IO) means a person who is fully qualified to investigate and prosecute matters involving marine casualties and other cases within the purview of R.S. 4450, as amended, and associated statutes.

2-4-60. LICENSING AND CERTIFICATING (LC)

A licensing and certificating (LC) inspector means person who is fully qualified to prepare, conduct, and rate examinations to be given persons apply
