rules which are agency statements of general or particular applicability and future effect designed to implement or interpret law, or to prescribe policy, or to describe the agency's organization, procedures, or practices. It also provides for certain procedures to be followed in "rule making" proceedings, which means the agency process for the formulation, amendment or repeal of a rule or regulation. The procedures of the Coast Guard required to be published by the Administrative Procedure Act are published in 33 CFR Part 1 and 46 CFR Parts 1 to 4, inclusive. It must be remembered that the requirements applying to rules and regulations and rule making procedures are in addition to requirements that may be prescribed by the law under which the rule or regulation is authorized.

1-2-200E. Authority for Rules and Regulations

The statutory authority for the Coast Guard to issue rules and regulations is within specific laws dealing with specific subjects. There is no single statutory authority applicable to all rules and regulations. The various government departments have been reorganized and functions have been vested in the head of the agency or department with authority to delegate to subordinate officers. See Reorganization Plan No. 26 for the Treasury Department. The Secretary of the Treasury has redelegated authority to the Commandant to promulgate rules and regulations, which are published in Titles 33 and 46 of the Code of Federal Regulations. The Federal Register Division has arranged these

rules and regulations in sales publication form with the Superintendent of Documents (with annual pocket supplements) as follows:

Title 33--Navigation and Navigable Waters, Code of Federal Regulations, 1949 edition.

Title 46--Shipping (Parts 1 to 145), Code of Federal Regulations (revised 1952).

Title 46--Shipping (Part 146 to end), Code of Federal Regulations (revised 1953).

1-2-200F. Arrangement of Rules and Regulations

The rules and regulations of the Coast Guard are published in the Federal Register and the Code of Federal Regulations of the United States, as Chapter I of Title 33--Navigation and Navigable Waters, and as Chapter I of Title 46-Shipping. The rules and regulations issued by all Federal agencies are published in the Federal Register and the Code of Federal Regulations. The Code of Federal Regulations is arranged in a manner similar to the United States Code. It is divided into 50 titles of general subjects. The agencies that have regulations pertaining to certain general subjects are assigned chapters in the various titles of the Code of Federal Regulations.

1-2-200G. Official Publication of Rules and Regulations

The Federal Register Act requires the publication of all rules and regulations in the daily issue of the Federal Register and in the Code of Federal Regulations.

PART 1-3--DIRECTIVES AND PUBLICATIONS

1-3-1. PRINTING AND DISTRIBUTION

1-3-1A. Purpose

The directives and publications pertaining to merchant marine safety are intended to assist in the performance of assigned duties. The directives set forth statements of policy, procedures, interpretations, or other information pertaining to a single subject or problem. Each publication is limited to a single general subject and may be intended for use of Coast Guard personnel only or for distribution to the public. Publications may consist of laws, rules, regulations, or instructions and are assigned permanent numbers. The type and mode of printing for each directive and publication varies according to the quantity needed and purpose intended.

1-3-1B. Distribution

The directives and publications are distributed to Coast Guard units, including marine inspection offices, in accordance with the policies and procedures governing such matters. The required distribution is indicated in accordance with the "Standard Distribution List, "CG131. The retention and cancellation of directives and publications is in accordance with the "Directives and Publications Index," CG-236. For certain directives and publications bulk quantity distribution is made to OC MIs in accordance with Mailing List 112."

Mailing List 112 was evolved in order to assure each OCMI with a continuing supply of directives and publications, adequate to his office needs and for

1-3-2A(4). Merchant Marine Safety Instructions.

The Merchant Marine Safety Instructions will be used for the purpose of transmitting to officers and personnel in the field administrative notices or instructions of temporary application.

1-3-2A(5). Navigation and Vessel Inspection circulars.

The Navigation and Vessel Inspection circulars will be used for the purpose of transmitting informational material to the public.

1-3-2B. Local Control

HQ will distribute to the field through the district commanders and OCMIS initial quantities of publications containing material described in 1-3-2A. Additional quantities should be requisitioned through channels. The district commanders and OCMIs are responsible for maintaining official files containing all current publications and papers containing the material described in 1-3-2A, which pertains to merchant marine safety activities within their jurisdiction.

1-3-2C. Requisitioning Pamphlets from HQ

The instructions covering preparation and submission of requisitions for pamphlets are contained in the Comptroller's Manual. The letter request shall be prepared in triplicate and sent to the Commandant (CHS) via the district commander.

1-3-2D. Requisitioning Blank Forms

The instructions for requisitioning blank forms are contained in the catalog of Forms, CG-218. It is especially important that these instructions be followed in order to be assured of adequate supplies.

1-3-3. MERCHANT MARINE SAFETY MANUAL

1-3-3A. Purpose

The Merchant Marine Safety Manual governs the administration of merchant marine safety activities by Coast Guard personnel. All mandatory instructions of a continuing nature in the field of merchant marine safety will be issued in this form.

1-3-3B. Form

The instructions in the Merchant Marine Safety Manual will be divided into chapters, parts, sections, and paragraphs. (Paragraphs may be divided into subparagraphs where necessary.)

1-3-3C. Code Numbers

The various chapters, parts, sections, and paragraphs of the Manual will be coded according to a system of numbering intended to identify the several parts and to facilitate reference to the instructions. Arabic numbers are used. The numbers of the chapters, parts, and sections are separated from each other by dashes. The paragraphs are identified by capital letters, subparagraphs by Arabic numerals in parenthesis, and subdivisions of subparagraphs by small letters in parenthesis. This passage, for example, is in 1-3-3C meaning Chapter 1, Part 3, Section 3, Paragraph C of the Merchant Marine Safety Manual. In certain instances variations will be allowed in numbering of subparagraphs to facilitate references to regulations or instructions adopted by the Commandant. All references to the instructions in the Merchant Marine Safety Manual will be made by referring to number of chapter, part, section, and letter of paragraph or letter of paragraph and number of subparagraph if a subparagraph. For example, reference to this paragraph would be "see 1-3-3C."

The Merchant Marine Safety Manual Amendments will be used to transmit new or revised pages for inclusion in the Merchant Marine Safety Manual or to cancel pages from the manual. The Merchant Marine Safety Manual Amendment will contain a brief statement of changes made in the manual and reason for such change. They will serve to identify and authorize the change in the Merchant Marine Safety Manual, to explain the effect of the change, to give the administrative reason (where appropriate for the change), and to give the instructions as to the insertion of the new pages in the manual and the removal of the old pages. The control sheet at the front of the manual should be used to note when each amendment was received and inserted in the manual.

1-3-4C. Distribution

Merchant Marine Safety Manual Amendments will be distributed from Headquarters in the same numbers and to the same persons as Merchant Marine Safety Manual. The OCMI shall make such distribution of the amendments to members of his staff as is necessary to insure that each person has at hand those instructions governing the work to which he is regularly assigned.

Each district commander and OCMI will be held responsible for maintaining a

The Merchant Marine Safety Instructions will be used to either transmit information or instructions of such temporary applicability that they need not be retained in the Merchant Marine Safety Manual or transmit emergency instructions pending their inclusion in the Merchant Marine Safety Manual. It is intended that all memorandums be of a temporary nature and will be in effect for no longer than 1 year from the date of issuance unless specifically extended by a subsequent memorandum.

1-3-5C. Distribution

The Merchant Marine Safety Instructions will be distributed to the same persons as Merchant Marine Safety Manuals. 1-3-5D. Official Master Files

Each district commander and OCMI will be held responsible for maintaining a master file of all Merchant Marine Safety Memorandums. Other persons receiving Merchant Marine Safety Instructions may make such temporary use of them as they desire and then destroy

them.

1-3-6A. Issuance

The Navigation and Vessel Inspection Circulars are issued by HQ in the form
