Mr. Pettis called up, and the House proceeded to consider, the report of the Committee of Elections in the case of Chaves vs. Clever, from the Territory of New Mexico, the pending question being on the following resolutions, viz: '

Resolved, That Hon. Charles P. Clever is not entitled to a seat in the fortieth Congress as a delegate from the Territory of New Mexico.

Resolved, That Hon. J. Francisco Chaves is entitled to a seat in the fortieth Congress as a delegate from the Territory of New Mexico.

After debate,

The hour of 41 o'clock p. m. having arrived, the House took a recess until 74 o'clock p. m.

After the recess,

The House, in pursuance of previous order, resolved itself into the Committee of the Whole House on the state of the Union; and after some time spent therein the Speaker resumed the chair, and Mr. Ferry reported that the committee having had under consideration the special order, viz: H. R. 1803. A bill making appropriations for the support of the army for the year ending June 30, 1870, had directed him to report the same with sundry amendments.

Pending which,

Mr. Blaine submitted an amendment to the last of the said amendments.

Pending which,

Mr. Blaine moved the previous question; which was seconded and the main question ordered to be put;

“SEC. — And be it further enacted, That until the military force is reduced to twenty regiments of infantry, five regiments of cavalry, and five regiments of artillery, no neio commission shail be issued in any regiment ; and the Secretary of War is hereby directed to consolidate regiments as rap. idly as the requirements of the public service and the reduction in the number of officers will permit, until the before-named minimum is reached.

“SEC. And be it further enacted, That until otherwise directed by law there shall be no new appointments and no promotions in the Adjutant General's department, in the Inspector General's department, in the pay depart. ment, in the quartermasters' department, in the commissary department, in the ordnance department, in the engineer department, and in the medical department ;" The question was put, Will the House agree thereto?
