Mr. Pike moved that the vote last taken be reconsidered, and also moved that the motion to reconsider be laid on the table, which latter motion was agreed to.

By unanimous consent, Mr. Stone, Mr. Henry D. Washburn, Mr. Burt Van Horn, Mr. Pomeroy, Mr. Gove, and Mr. Kerr, were excused from attendance at this evening's session.

A message from the Senate by Mr. McDonald, their chief clerk.

Mr. Speaker: The Senate have passed joint resolutions and bills of the House of the following titles, viz:

H. Res. 120. Joint resolution in regard to the publication of postal conventions made with foreign countries;

H. Res. 458. Joint resolution granting the consent of Congress provided for in section ten of the act incorporating the Northern Pacific Railroad Company, approved July 2, 1864;

H. R. 281. An act for the relief of Edwin B. Hoag;

H. R. 1549. An act to restrict and regulate the franking privilege; severally without amendment; and

H. R. 1967. An act to compensate the officers and crew of the United States steamer Kearsarge, for the destruction of the rebel piratical vessel Alabama; and

H. R. 112. An act relating to captures made by Admiral Farragut's fleet in the Mississippi river in May, 1862;

with amendments, in which I am directed to ask the concurrence of the House.

The Senate have also passed a joint resolution of the following title, viz:

S. R. 207. Joint resolution authorizing Lieutenant Commander W. A. Kirkland, United States navy, to accept a gold medal from the Emperor of France;

in which I am directed to ask the concurrence of the House.

Mr. Kelley, by unanimous consent, submitted the following resolution; which was read, considered, and agreed to, viz:

Resolved, That the Secretary of State be directed to take immediate measures to ascertain the cause of the arrest and incarceration, by order of the captain general of Cuba, of Emilio Cabada, a citizen of the United States.

Mr. Benjamin F. Butler, by unanimous consent, submitted the following resolution; which was read, considered, and agreed to, viz:

Resolved, That the expenses incurred in removing the remains of the late Hon. Thaddeus Stevens to his home in Pennsylvania be paid out of the contingent fund of the House.

Mr. Churchill, by unanimous consent, from the Committee on the Judiciary, reported a bill (H. R. 1987) to define felonies and misdemeanors, and regulate peremptory challenges; which was read a first and second time.

Ordered, That it be engrossed and read a third time.

Being engrossed, it was accordingly read the third time and passed. Ordered, That the Clerk request the concurrence of the Senate therein. On motion of Mr. Beaman, by unanimous consent,

Ordered, That the general debate on the bill of the House (H. R. 1808) making appropriations for the service of the Post Office Department

during the fiscal year ending the 30th June, 1870, shall cease in five minutes after the same is considered.

On motion of Mr. Beaman the House resolved itself into the Committee of the Whole House on the state of the Union; and after some time spent therein the Speaker resumed the chair, and Mr. Poland reported that the committee having had under consideration the special order, viz: H. R. 1808. A bill making appropriations for the service of the Post Office Department during the fiscal year ending the 30th of June, 1870, had found itself without a quorum, and that he had caused the roll to be called when it appeared that the following-named members had failed to answer to their names, viz:

The Speaker pro tempore decided, in view of the precedent in the last Congress, that the said motion was out of order in the absence of a quorum.

From this decision of the Chair, Mr. Schenck appealed.
